In 2000, an Ecology official told us the clean u...↓p would take four to six years. 25 years later we are given an estimate of an additional 10 years.

With all the studies and preparatory work already done, there is no technical reason the cleanup could not be completed in well under five years. Rayonier received an excellent financial deal from Ecology's forbearance, being able to postpone the $30 million cleanup cost by already 28 years. They should be informed now that the cleanup must proceed on an expedited schedule, or else Ecology will declare them unable to carry out the clean up as required and conduct the cleanup itself using funds from the Hazardous Substance Tax, pursuing recovery of the costs from Rayonier. The citizens of Port Angeles deserve no further delay in restoring the centerpiece of their waterfront

2. The upland cleanup timetable should not be tied to the marine cleanup if the latter takes longer, so that the land portion of the cleanup area can be sold by Rayonier and placed back into productive use as soon as possible.

3. The Natural Resource Damage Assessment (NRDA) process should not delay the cleanup, nor prevent Rayonier from being incentivized to eventually make the property available for productive use again. Any Ennis Creek related restoration projects should not delay the conclusion of the upland area cleanup.

4. And, importantly, Rayonier should not be incentivized to never sell the property by being offered NRDA credits with a value in excess of the property's market value once cleaned up, for ceding the property for a nature or cultural preserve. Ecology cannot force Rayonier to sell the cleaned-up property, but it can make certain that eventually selling it is in Rayonier's economic interest.

As a former board member of the Port Angeles Harbor Works Public Development Authority, I want to dispel the narrative that Harbor-Works failed because it was concluded that the Rayonier property would never have any commercially valuable use once cleaned up. This was not the case. The Rayonier property could be an important engine for the economy of the City of Port Angeles, with a tribal cultural center, such as proposed by the Jamestown S'Klallam Tribe, an Anthony's Restaurant, a marina, light marine industry, or many other alternative potential uses.

Harbor-Works failed because with the glacially slow pace of the cleanup and Ecology's inability or unwillingness to place pressure on Rayonier for a prompt cleanup, Rayonier had no incentive to make a deal that involved a quick cleanup. A dollar spent today is worth much more than a dollar spent 20 years from now. 16 years later, things have worked out exactly as Rayonier had hoped when Harbor-Works failed – it has not yet had to pay the $30 million for the cleanup and under the current schedule would not have to do so for many years to come.

I have lived in Port Angeles since 1988 and every time someone from Ecology speaks we see almost the same slides and hear the same story "another 7-10 years" I will likely be dead before it gets closure!!! PLEASE, take a stand for our community and demand that this is completely resolved (cleaned and ready for development) in the 5 years!!! Thank you

I have 2 comments:

1) My primary concern is the proposed site location of the 55,000 cubic yards of contaminated soil that will be capped with 2 feet of topsoil. I find no mapped digital elevation data in the project records that show the consolidated dirty soil location's height above mean sea level. Though Ecology quickly dismissed the many public questions about tsunami risks with suggestions that project climate change analysis would address this, a tsunami is an independent earth movement risk event needing its own analysis. Yes, climate change may raise seawater levels across some selected future time period and augment or enhance a tsunami's potential destructive power. But a tsunami could happen immediately and is not a risk event to be lumped with climate change risks, nor treated as an uncertain distant potential event linked to the uncertainties of climate change.

Elevation data absence aside, tsunami heights classically in the Pacific Northwest are modeled by universities to be particularly destructive in an elevation zone of 15 to 30 feet above sea level. These are only estimations of the height and area extent that might be affected by Geographic Information System mapping which can easily map and delineate the extent of an indundation area 30 feet (or greater) above mean sea level.

I propose you do the spatial analysis, examine the extent of potential tsunami-powered soil movement, and strongly consider removing that soil from the sealevel adjacency you now propose. Leaving the soil onsite pencils out as a cheaper alternative than removing 5500 10-cubic yard loads of soil, but failure to remove that soil leaves a high probabilty of dispersing all those contaminants you are concerned about across a much larger (and new) project area.

2) Finally, time is of the essence for a number of reasons, including widely expected increases in inflation, and the time risk exposure associated with protracted decision-making. I.e.: your high end project estimated cost of $28.7 million dollars is in 2019 year dollars. Consumer Price Index application, already today, only 6 years later pushes that figure to ~$36 million in today's dollars, a 25% increase to the costs you are using in discussions broadly about this project. You estimate 6 to 10 years to project completion and, conservatively, if completion is only 6 years ahead of us at 4% inflation that current $36 million will become 24% higher, which equals approximately $45 million in 2031 dollars, or $50 million in 2035 dollars 10 years out. These figures need to be used in current discussions so as to not underestimate budget needs by both Rayonier and by government.

I support the City of Port Angeles and many other governmental entities, nonprofit organizations,
and individuals for almost every comment submitted to the State Department of Ecology during the
last comment period — in 2019 — that Rayonier must be required to remove ALL contaminants
from its former mill site. For the latest report, Ecology officially released about five years later —
June 12, 2025 — Ecology has moved its preferred cleanup level only from Level 2 to 3, out of 5.
Level 5 is the only alternative that would excavate ALL contaminants and move them to a landfill,
like one in eastern Oregon, where they can be safely contained.
Rayonier was in operation for years. While living up hill from the mill I could watched the smoke from their stack. When the west wind blew the pollutants from the mill carried to Gales Addition.
In the 1980s the area east of Rayonier Mill was known as the 'cancer area'. I did not understand the name until I noticed when the wind was blowing from the west it settled in Gales Addition. When the wind blew northwest the pollution/contaminants traveled up the hill to where lived. I needed to close my home's windows and come inside if I was gardening.
I knew which way the wind was blowing because I could taste an acidic element in the air. The people of Port Angeles have suffered enough from the effects and negligence of Rayonier and the lack of adequate protection from government.
I worked for a business along Front Street. I was outside caring for merchandise and could not only see the gray cloud of pollution but taste it in the air. I mentioned this to a customer who told me he was from the government monitoring the air quality. He said they just fined the Mill $300.00. I gave a small laugh and said that what they spend on lunch.
I am happy to see something is finally getting done but it must be thorough and not just a patch. People's lives are at risk. Do the right thing get rid of these contaminants.
