Rulemaking - Chapters 173-400 and 173-401 WAC

Ecology is seeking public comments on the following actions:


  • Draft amendments to two air quality rules: Chapter 173-400 WAC, General Regulations for Air Pollution Sources and Chapter 173-401 WAC, Operating Permit Regulation


  • Draft updates to Ecology's Source Test Manual - Procedures for Compliance Testing


Amendments to Chapter 173-400 WAC will incorporate an updated version of the "Source Test Manual - Procedures for Compliance Monitoring" and update the rule's adoption date in WAC 173-400-025 for adoption of applicable federal rules by reference.


Amendments to Chapter 173-401 WAC will repeal the emergency affirmative defense provisions to align with EPA's July 2023 rule that repealed those provisions in federal operating permit regulations under Title V of the federal Clean Air Act.


Updates to the 2004 Source Test Manual will update dates and remove outdated source testing methods.
